⚖️ Understanding Infused Weight vs Dry Weight
You might notice that the lab test shows 0.573% THC — which seems higher than the 0.3% federal limit. Here’s why that’s okay:

Infused Weight: This is the percentage of THC relative to the full weight of the liquid (including carriers, flavors, and propellant). This is how most reputable labs test liquid products like inhalers, drinks, tinctures, etc.
Dry Weight Basis: The 2018 Farm Bill requires hemp products to contain <0.3% THC on a dry weight basis. For beverages and aerosols, compliance is evaluated per unit (container) or per serving — not by the weight of the raw extract alone.
In other words: The product may have >0.3% THC per gram of liquid, but still be compliant because each spray delivers <0.3% THC by weight.

Each 3.0 mL container provides ~150 sprays, ensuring precise, low-dose delivery every time.

 
Legal Compliance: 2018 Farm Bill + SB 2024 (Texas)
Federal Compliance
Our product meets the definition of hemp-derived under the 2018 Farm Bill, which legalized cannabinoids like Delta-9 THC as long as they don’t exceed 0.3% THC by dry weight. Our lab-verified formulation falls well below this limit per serving.

Texas SB 2024 Compliance
Senate Bill 2024 (Texas Health & Safety Code § 443.451) restricts e-cigarette products defined as:

“…a consumable liquid solution or other material aerosolized or vaporized during the use of an electronic cigarette…”
Our FitFam pMDI inhalers:

Do not use e-liquid or vapor coils
Deliver via pharmaceutical-grade aerosol propulsion, not heat or combustion
That’s why our product does not fall under the SB2024 prohibition and remains compliant for sale and distribution within Texas.

 

 ✅DSHS Rule Compliance

This inhaler contains ZERO THC-A. So the new total THC formula — THCA + Delta-9 — doesn't change its calculation at all. The inhaler was never THCA-based to begin with.

§300.101(38) — Official DSHS Definition of "Smoking": "Burning or igniting a substance and inhaling the resultant smoke or heating a substance and inhaling the resulting vapor or aerosol."

DSHS has deliberately written the broadest possible definition of "smoking." The word "or" is doing enormous work there. It doesn't just mean combustion — it explicitly includes heating a substance and inhaling the resulting vapor or aerosol. This was clearly written to capture vapes and e-cigarettes that don't technically "burn" anything.

HOWEVER - 

The inhaler uses no heat whatsoever. The propellant is pressurized gas — HFA 134a. Nothing is heated. Nothing is burned. The mist is produced entirely by mechanical pressure, not thermal energy. The formula temperature doesn't change at any point during actuation.

So under the plain language of this definition, the inhaler falls into neither category:

❌ Not burning or igniting anything
❌ Not heating anything
The aerosol is produced without heat — which is precisely why pharmaceutical pMDIs exist as a category distinct from vaporizers in medical literature.

The definition says "heating a substance and inhaling the resulting vapor or aerosol." The word "resulting" ties the aerosol to the heating. If there's no heating, there's no "resulting" aerosol under this definition — the aerosol just exists because of pressure.  This product doesn't meet the statutory definition of smoking because no heat is involved at any stage.
